ADN's commitment to protecting your data

PRIVACY POLICY

ADN Group, a limited liability company with share capital of €10,000, registered with the Paris Trade and Companies Register under number 792 816 928, and whose registered office is at 9 rue Guénégaud - 75006 PARIS (hereinafter "the Company"), is the data controller within the meaning of Regulation (EU) 2016/679, known as the General Data Protection Regulation (GDPR), for the collection and processing of personal data carried out on this website, hereinafter the Site.

As such, the Company undertakes to respect your personal data, that are collected and processed during your use of the Site. In this regard, the Company complies with European and French legislation on the protection of personal data, namely Regulation EU 2016/679, known as the "GDPR" and the amended French Data Protection Act of 6 January 1978, no. 78-17, known as "Informatique et Libertés".

This data protection policy applies to all services offered by ADN Group to which you subscribe (excluding services provided and operated by third parties, in which case the privacy policy of those third parties applies and should be consulted).

1 - Purposes of processing and legal bases

Your personal data may be processed via the Site for the following purposes:

- To enable the performance of the service;

- To inform the Client, with their express and prior consent, of any other operations that may be carried out, such as subscription to a newsletter;

- To conduct studies and research anonymously for the purpose of improving the online training service.

The Company's contact form on the Site is intended for the relevant departments of the Company, to inform you about the Company's activity, to enable the Company to make a quotation proposal on the basis of the information collected, and to process your request/message. Client data is retained for as long as necessary for the management of the commercial relationship. Prospect data of non-clients may be kept for up to three years from their collection or the last contact from the prospect, unless agreed otherwise for a longer period.

The Site sets cookies, provided you consent. This consent is formalised by clicking on the "Accept" button on the banner that appears when you visit the Site. Details regarding the data collected via these cookies, their collection purposes, recipients, retention periods, and a reminder of your rights are available in our Site Cookie Policy.

2 - Recipients

The personal data we collect, as well as those we may subsequently collect, are intended for us as the data controller.

2.1 Data transferred to third parties

We ensure that only authorised persons have access to this data. Our subcontractors/service providers may receive this data in order to perform the services we entrust them with. We only pass on to these third parties the data they need to perform their services or tasks, and we require them not to use your data for any other purpose.

When these third parties act as processors under current regulations, they only act according to our instructions and are contractually obliged to maintain the same level of security and confidentiality for your data as we do, in accordance with the GDPR.

2.2 Data transferred to authorities and/or public bodies

In accordance with current regulations, data may be transmitted to competent authorities upon request, specifically to public bodies, legal representatives, ministerial officers, organisations responsible for debt recovery, exclusively to fulfil legal obligations, as well as in the event of the search for perpetrators of offences committed on the internet.

3 - Data retention period

Your data will not be retained beyond the period strictly necessary for the purposes described in this privacy policy, in line with GDPR requirements.

In this respect, we retain your data:

- For learners, ADN Group undertakes to delete data provided three years after their last registration.

- For newsletters, data is kept until you withdraw your consent or, if not, three years from your last contact with us.

- For cookies and other technologies, the retention period is 13 months.

Your data is deleted when retention periods expire. However, your data may be archived beyond these periods for the applicable legal limitation periods and for the purpose of investigation, identification, and prosecution of criminal offences, solely to make your data available to the judicial authority if required.

Archiving means that your data will no longer be accessible online but will be extracted and stored securely and separately.

All data is stored within the territory.

4 - Your data is protected

We take the protection, integrity, and confidentiality of your data very seriously. Accordingly, we implement appropriate technical and organisational measures to prevent unauthorised access or modification, disclosure, loss, or destruction of your data.

However, despite our efforts, no security measure can protect against all risks of misappropriation or hacking, for which, as data controller, we cannot be held liable. It is important that you keep your login details confidential to prevent unlawful use of your account.

5 - Your rights

In accordance with Law No. 78-17 of 6 January 1978 as amended and the GDPR, you have a number of rights relating to your data.

5.1 Your right to information

You acknowledge that this privacy policy informs you of the purposes, legal framework, interests, recipients, or categories of recipients with whom your personal data is shared, and the possibility of data transfer to a third country or international organisation.

In addition to this information and with a view to ensuring fair and transparent processing of your data, you confirm you confirm that you have received additional information concerning:

- the retention periods for your personal data;

- the rights granted to you and how to exercise them.

 

If we decide to process data for purposes other than those indicated, all information about these new purposes will be communicated to you.

5.2 Your right of access and rectification

By exercising this right, you can confirm whether or not your personal data is being processed and, where it is, have access to your data alony with information regarding:

- the purposes of processing;

- the categories of personal data concerned;

- the recipients or categories of recipients, particularly those established in third countries;

- when possible, the envisaged storage period for your personal data, or, if not possible, the criteria used to determine that period;

- the existence of the right to request from the data controller the rectification or erasure of your personal data, the right to request restriction of processing of your personal data, or to object to such processing;

- the right to lodge a complaint with a supervisory authority;

- information about the source of the data if not collected directly from you;

- the existence of automated decision-making, including profiling, and, where relevant, meaningful information about the underlying logic, as well as the significance and expected consequences of this processing for you;

You may ask us to rectify or complete your personal data if it is inaccurate, incomplete, ambiguous, or out of date.

5.3 Your right to erasure

You may request the erasure of your personal data where one of the following grounds applies:

- the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;

- you withdraw your previously given consent;

- you object to the processing of your personal data where there are no legitimate reasons for such processing;

- the processing of your personal data does not comply with applicable legislative and regulatory provisions;

- your personal data was collected when you were a minor.

This right does not apply if retention is required by law or regulation, including, for example, for the establishment, exercise, or defence of legal claims.

 

5.4 Your right to restrict processing

You may request restriction of the processing of your personal data in cases provided for by law and regulation.          

5.5 Your right to object to processing

You have the right to object at any time to the processing of personal data concerning you when the processing is based on the legitimate interest of the data controller.

This is not an absolute right and we may refuse your objection for legal or legitimate reasons.

For direct marketing communications, you may exercise this right by any means, including by clicking on the unsubscribe links at the bottom of our communications.

5.6 Your right to data portability

You have the right to receive the data you have provided to us, in a structured, commonly used, and machine-readable format, for your own use or to transmit them to a third party of your choice. The data to which this right applies is:

- only your personal data, excluding anonymised data or those not relating to you;

- declarative personal data and operational personal data;

- personal data that does not infringe on the rights and freedoms of others, such as those protected by trade secrets.

This right is limited to processing based on consent or contract, and to personal data you have personally generated.

This right does not include derived or inferred data, which are personal data created by the data controller.

5.7 Your right to withdraw consent

Where the data processing we carry out is based on your consent, you may withdraw it at any time. Withdrawal of consent does not affect the lawfulness of any processing based on consent carried out before such withdrawal.
